Employee Handbooks

Employee Handbook Seminar  March 16, 2005

Most employers today have an employee handbook of some sort that is distributed to the staff of the company. But, what are your answers to the following?:

  • Who wrote this document? Attorney? Copied from some other company’s handbook?
  • How current are the policies? Over a year old? Two years? Longer?
  • Are you finding that the language creates inconsistency in how policies are handled?
  • Will it help or hinder your company in a complaint scenario?

If you find that your answers create doubt in your mind, then it is time to have it reviewed to see where you are based on current trends in the workplace. There are specific needs that must be addressed and presented in a way that will help to place the company in a defensible position when problems arise. Will yours accomplish this?

Many organizations have outdated harassment polices, no policy on cellular telephone usage while driving, inconsistent language that can nullify the "At-Will" employment concept and policies that are no longer enforced or are enforced differently then what is in writing. The liability can be enormous in money loss to your company.

When we create an Employee Handbook, it is consistent with recent laws and court decisions. This includes such areas as Sexual Harassment, "Americans With Disabilities Act of 1990", the "Civil Rights Act of 1991" and updates, “Family Medical Leave”, "Health Care Portability Act" and Workplace Violence issues. Our approach is that an Employee Handbook should answer more questions than it creates.
